  1. This is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
  2. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name www.ninetalespublishings.com ('Website'), including the related mobile site and mobile application (hereinafter referred to as 'Platform').
  3. Your use of the Platform and services and tools are governed by the following terms and conditions (“Terms of Use”) as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, you shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, you shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, 'Services'). Any terms and conditions proposed by You which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.
  4. For the purpose of these Terms of Use, wherever the context so requires 'you', 'your' or 'user' shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.
  5. ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.
  6. If you are accessing the Platform on behalf of a legal entity (such as a business), the entity accepts these Terms. The entity agrees to indemnify Ninetales Publishings and its employees, directors, and affiliates from any suits, claims, legal proceedings, or actions arising out of or connection with your/its use of the Platform, including but not limited to costs incurred in respect of claims, damages, losses, and attorney fees.
  7. The use of Platform and/or availing of our Services is subject to the following Terms of Use:
    1. To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform
    2. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
    3. Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.
    4. The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents include and is not limited to the design, layout, look and graphics.
    5. You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.
    6. You agree to pay us the charges associated with availing the Services.
    7. You agree not to use the Platform and/ or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you.
    8. You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. These links are provided for your convenience for provide further information.
    9. You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.
    10. You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
    11. Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
    12. All comments and feedback submitted via your Account, whether by you or not, to the Platform comply with these Terms, will be considered non-confidential and non-proprietary, do not infringe on contractual, intellectual property, privacy, publicity, or other rights of any third party, you have all the necessary licenses, rights, consents, and permissions to use all comments and feedbacks, and you otherwise will comply with all applicable laws, rules and regulations regarding your use of the Platform.
    13. These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.
    14. You will not, via the Platform or otherwise, cause damage to the Platform or impair the availability or accessibility of the Platform in any way which is fraudulent, unlawful, illegal, or harmful, including, without limitation, modifying, adapting, bypassing. or hacking the Platform to change, de-crypt, interrupt, destroy, or limit the functionality of our, or other user's computer software, hardware or telecommunications equipment or attempt to gain unauthorized access to our servers or computer system or engage in any activity that inteferes with the performance of, or impairs the functionality of, the Platform. Without limiting the foregoing, you must not misuse the Platform by knowingly introducing viruses, troojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to get unauthorized access to the Platform, the servers on which Platform is stored, or any server, computer or database connected to the Platform. We will report any such breach to the relevant law enforcement authorities, and we wiil cooperate with those authorities by disclosing your identity and any other relevant information to them as may be required to support law enforcement activites.
    15. You will not upload, post, host, or transmit unsolicited correspondence, emails, "spams" messages, worms, or viruses or any code of a destructive nature to the Platform nor contact any other visitor or user of the Platform for any illicit purpose or who has requested not to be contacted; access the Platform through unpermitted means.
    16. All concerns or communications relating to these Terms must be communicated to us using the contact information provided on this website
  8. We reserve the right to require you to create a User Account in order to access parts or all of the platform. You are responsible for all activities that take place on your account, and for ensuring that your login details remian confidential. If you share access to your account, any person accessing the Platform through your account is also bound by these Terms. We do not accept any liability for any losses that you may incur as a result of unauthorized access to your account. You may, however, be liable for any losses that Ninetales Publishings incurs as a result of such unauthorized access
  9. You may never use another person's user account or registration information without permission. You must notify us immediately of any change in your ability to use the Platform, breach of security or any unauthorized use of your account. You should never publish, distribute or post login information for your account.
  10. We reserve the right to delete, suspend, or remove access to your account, at our sole discretion, including for your non-compilance with these Terms.
  11. Content :
    1. You may submit content to the Platform, including feedback, query, text, or other multimedia, provided that such content is in line with these Terms and our Community Guidelines, as updated from time to time. Notwithstanding anything else in these Terms, you are solely responsible for any and all content you submit onto the Platform, including any and all risks related to its publication and display, including someone else's reliance on its accuracy and any claims relating to intellectual property or other legal rights.
    2. You acknowledge and agree that any content you submit onto our Platform will not violate the intellectual property or other rights of any third party. You further acknowledge and agree that any content you submit onto our Platform is either owned by you or you have the necessary licenses to do so (including to grant sublicenses), and that all content submitted to the Platform (including the works of Ninetales Publishings commissioned authors) is original and free from plagiarism. We do not review content for plagiarism and therefore will not be held liable if any content posted is in violation of any third-party's rights. We reserve right to pursue legal action as best advised against any users who submit plagiarised or infringing content.
    3. Subject to the provisions of Clause 11(b) above, Ninetales Publishings makes no claim to the rights in copyright of any content submitted by you.
    4. We may enable advertising on the Platform in order to help us run the Platform. We may also use the content submitted on the Platform for marketing/promotional purposes.
    5. We do not allow the infringement of copyright on the Platform, and will remove any content that we deem to be in infringement of a third-party's rights.
  12. All rights, titles, and interests in and to the Platform are owned, licensed or otherwise controlled by Ninetales Publishings. This includes, without limitatin, the Platform's look and feel, source and object code, visual design elements, trademarks (wether registered or not), and any other works protectable under intellectual property or other applicable laws.
  13. We do not make any representations or warranties regarding the accuracy or validity of any content provided thereon. While we will make reasonable efforts to ensure the accuracy of any content displayed on the Platform, we shall not be held liable for any discrepancies in this regard.
